Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Aviation Vortex website and any related communications, forms, and services provided by Aviation Vortex (“we”, “us”, “our”).

Important summary (plain language)

  • We are a charter agent/broker. We do not operate aircraft and we do not publish fixed pricing.
  • Quotes are indicative until confirmed in writing and subject to aircraft availability, positioning, permits/slots, crew duty limits, weather, and operator approval.
  • The actual flight is performed by a properly licensed third-party operator under their own operational control and terms.
  • By submitting a request, you confirm the information you provide is accurate and you agree not to use this service for any unlawful or abusive purpose.

1) Definitions

“Charter” means arranging or coordinating air transportation services through a third-party aircraft operator.

“Operator” means the properly licensed air carrier / air operator that provides the aircraft, crew, operational control, and performs the flight.

“Client” means the person or entity requesting or purchasing charter services.

“Quote” means pricing and operational details provided based on the request, subject to confirmation and Operator acceptance.

2) Our role (Agent/Broker only)

Aviation Vortex acts as a charter agent/broker that sources and coordinates charter options through vetted third-party Operators. Unless expressly stated in writing, we do not act as an air carrier and do not have operational control of flights.

The Operator is solely responsible for flight operations, regulatory compliance, aircraft airworthiness, crew qualifications, safety procedures, and performance of carriage. Your flight may be subject to the Operator’s own terms, passenger rules, and carriage conditions.

3) Eligibility and authorized use

You confirm that you have legal capacity to enter into these Terms and, where applicable, authority to bind your organization.

You agree not to use the website, forms, or services for:

  • unlawful purposes, fraud, or misrepresentation of identity, passengers, or payment authority;
  • harassment, abusive communications, spam, or automated scraping of content;
  • circumventing security controls or attempting to access restricted areas without authorization;
  • requests involving sanctioned parties or prohibited destinations under applicable laws.

4) Quotes, availability, and what affects pricing

Charter pricing is not menu-priced. Quotes depend on aircraft category, routing, positioning, crew duty limits, airport access constraints, seasonal demand, and Operator availability.

Quotes are subject to change until confirmed

  • Aircraft may become unavailable before confirmation.
  • Permits/slots may be required depending on airports, timing, and aircraft type.
  • Short-notice changes, weather disruption, and operational restrictions can affect final availability and pricing.

We may request clarifications to improve quote accuracy (route, date window, passenger count, baggage, pets, catering, ground handling preferences, etc.). Providing incomplete or inaccurate information may delay response or invalidate a quote.

5) Booking, confirmation, and documentation

A booking is confirmed only when you receive written confirmation and applicable payment terms are satisfied (as specified by us and/or the Operator). The Operator may require passenger identity documentation and acceptance of carriage terms.

You are responsible for ensuring passenger details are correct (names, ID/passport where required, nationality, and any special assistance needs). For international travel, you are responsible for visas, entry requirements, health documentation, and compliance with all applicable laws.

6) Payments, deposits, and fees

Payment terms vary by Operator, aircraft category, and lead time. Deposits and full prepayment may be required. Additional charges may apply depending on circumstances (for example: de-icing, extended crew duty, diversions, parking, special handling, additional permits, or catering beyond the agreed scope).

We do not store full card numbers on the website unless explicitly implemented and disclosed. Where payment is handled via invoice/bank transfer or operator-managed payment flows, you must follow the provided instructions.

Anti-fraud note: we may request reasonable verification to confirm authority to pay and to protect Operators and clients.

7) Cancellations, changes, and refunds

Cancellations and changes are subject to the applicable Operator’s policy and the terms in your confirmation documents. Fees may apply based on timing, aircraft positioning already performed, crew commitment, and airport/permit costs.

If you request changes (date/time/airports/passengers), a revised quote may be required. Certain changes may not be feasible due to permit/slot or operational constraints.

Refundability depends on the confirmed terms and what costs have been incurred. Where refunds are permitted, processing time may vary based on banking and operator settlement timelines.

8) Passenger conduct and special items

You and your passengers must comply with Operator rules, airport rules, crew instructions, and applicable law. Prohibited items are not allowed. Special items (pets, firearms (where lawful), hazardous materials, oversized baggage) require advance approval and may be restricted or refused by the Operator.

If passenger behavior or items create safety, compliance, or security risk, the Operator may deny carriage. Fees may still apply according to the confirmed cancellation policy.

9) Force majeure and operational disruptions

Flights can be affected by factors outside anyone’s control (weather, air traffic control restrictions, airport closures, geopolitical events, regulatory actions, mechanical issues, crew duty limits, or safety concerns). In such cases, the Operator may delay, reroute, substitute aircraft, or cancel for safety/compliance reasons.

We will use commercially reasonable efforts to coordinate alternatives, but we do not guarantee uninterrupted service. Charges may apply depending on the Operator’s policies and costs already incurred.

10) Disclaimers and limitation of liability

The website and informational content are provided on an “as-is” and “as available” basis. We do not warrant that the site will be error-free, uninterrupted, or that all content is complete or current at all times.

To the maximum extent permitted by law, Aviation Vortex is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website or services, including loss of profits, business interruption, or loss of data.

Where our liability cannot be excluded by law, it will be limited to the amount of fees paid to us for the relevant service giving rise to the claim (if any), unless otherwise required by applicable law.

11) Indemnity

You agree to indemnify and hold harmless Aviation Vortex from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms, (b) misuse of the website or services, (c) inaccurate or unlawful passenger/payment information you provide, or (d) violations of law or Operator rules.

12) Intellectual property

All website content, branding, text, layouts, and design elements are owned by or licensed to Aviation Vortex. You may view and use the site for your personal or internal business use. You may not reproduce, distribute, or commercially exploit site content without written permission.

13) Privacy

Our collection and use of personal data are described in our Privacy Policy. By using the site or submitting a request, you consent to the processing described there.

14) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date indicates the latest revision. Material changes may be posted on the site. Continued use of the site after updates means you accept the revised Terms.

15) Governing law and disputes

These Terms are governed by the laws of the jurisdiction where the service provider is established. Any dispute arising from these Terms will be submitted to the courts of the jurisdiction where the service provider is established, unless mandatory laws require otherwise.
